We have had a significant number of requests for term time holidays this year. For the last two years we have not issued any fixed penalty fines as we understand that holidays have been affected by the pandemic due to postponements/cancellations etc. 

We do not authorise any term time holidays.

From September 2022 we have been instructed to issue fixed penalty fines for term time holidays of any length.

The current legislation is as follows:

The Education (Pupil Registration) (England) Regulations 2006 Amendments to the 2006 regulations remove references to family holiday and extended leave as well as the statutory threshold of ten school days. The amendments make clear that Head teachers may not grant any leave of absence during term time unless there are exceptional circumstances. Head teachers should determine the number of school days a child can be away from school if the leave is granted.

The Education (Penalty Notices) (England) Regulations 2007 Penalty notices will be requested for those families who take their children out of school during term time. Penalty notices are issued to both the child’s parents separately and for each child in the family whose attendance or punctuality meets the criteria. Penalties are set at £60 per child, per parent, if paid within 21 days, rising to £120 if paid after the 21 days but within 28 days. Once the penalty is paid the absence covered by the penalty notice cannot be cited again.
